You agree to comply with all applicable local, state, national, and international laws, regulations, and rules in connection with your use of the Service. This includes, but is not limited to, laws regarding securities and investment analysis, as well as privacy laws.

3.5. Reporting Violations

If you become aware of any unauthorized use of the Service or any violation of these Terms, you agree to notify us immediately at info@alpharank.app. We reserve the right to investigate and take appropriate action at our discretion, including terminating your access to the Service.

While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any content or information provided through the Service. You acknowledge that the financial markets are volatile and that the information provided may change rapidly. AlphaRank shall not be liable for any failure to perform its obligations under these Terms where such failure results from any cause beyond AlphaRank’s reasonable control, including, but not limited to, mechanical, electronic, or communications failure or degradation.

6.4. Damage Limitations

If, despite the other provisions of these Terms, AlphaRank is found to be liable to you for any damages or losses arising from your use of the Service, our liability shall not exceed the amount you paid to us for the Service during the twelve (12) months preceding the event giving rise to your claim

6.5. Exclusions

Some jurisdictions do not allow the exclusion or limitation of certain damages or liabilities, so the above limitations and exclusions may not apply to you. In such jurisdictions, the liability of AlphaRank shall be limited to the maximum extent permitted by law.

7. Indemnification

You agree to indemnify, defend, and hold harmless AlphaRank, its affiliates, and their respective officers, directors, employees, agents, and licensors (collectively, the “Indemnified Parties”) from and against any and all claims, liabilities, damages, losses, expenses, costs, and fees (including reasonable attorneys’ fees) arising out of or related to:

7.1. Your Use of the Service

• Any use of the Service that is not expressly authorized by these Terms or any violation of these Terms by you.
• Your actions or omissions in connection with your use of the Service, including any conduct that violates any applicable laws or regulations.

7.2. Content You Provide

• Any content you submit, post, or otherwise transmit through the Service, including any claims that such content infringes, misappropriates, or violates any intellectual property rights, rights of privacy, or rights of publicity of any third party.
• Your breach of any representation, warranty, or obligation contained in these Terms or any applicable laws or regulations.

You agree to promptly notify AlphaRank of any claims or potential claims for which indemnification is sought under this Section. AlphaRank reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you. In such cases, you agree to cooperate with AlphaRank in asserting any available defenses.

7.6. Limitations on Liability for Indemnification

This indemnification obligation is in addition to any other rights and remedies available to AlphaRank at law or in equity. You acknowledge that the Indemnified Parties may be irreparably harmed by your breach of this indemnification provision, and that they may seek injunctive relief to enforce this provision in addition to any other remedies available.

8. Refund Policy
We want you to be satisfied with your purchase from AlphaRank. If, for any reason, you are not satisfied with the service, you may request a refund within 7 days of your initial purchase under the following conditions:

8.1. Eligibility for Refunds
The refund request must be submitted within 7 days of the initial purchase date. Refunds are only available for first-time purchases of subscription services or one-time products. If you have previously received a refund for the same service, further refunds may not be granted. Refunds are not available for services that have been fully used or accessed extensively during the 7-day period.

8.2. How to Request a Refund
To request a refund, please contact our customer support team at info@alpharank.app with the following details:

• Your full name and email address associated with the account
• The date of purchase
• Reason for requesting a refund

8.3. Processing Refunds
Once we receive your refund request, we will review your case. If the request meets our eligibility criteria, the refund will be processed within 10 business days. The refund will be credited back to the original payment method used during the purchase. Please note that processing times for your bank or credit card provider may vary.

8.4. Non-Refundable Services
Certain services may not be eligible for refunds, including but not limited to:

• Services that have been substantially used within the 7-day period
• Promotional offers or discounts that explicitly state they are non-refundable
• Any additional services or custom features added after the initial purchase

We reserve the right to decline a refund if we determine that the request does not meet the eligibility criteria outlined in this policy.

9. No Brokerage Services
AlphaRank is a financial analysis and information platform. We are not a licensed broker, dealer, or financial advisor, nor do we act on behalf of any brokerage firm. The services and information provided through our website and application are for informational purposes only and are not intended to facilitate or execute any financial transactions on behalf of the user.

9.1. No Financial Transactions

AlphaRank does not handle client funds or assets and does not engage in any financial transactions such as the buying or selling of stocks, securities, or other financial instruments.

We do not offer investment, tax, or legal advice, nor do we conduct any operations on behalf of clients, such as placing orders for securities or managing investment portfolios.

9.2. Interaction with Brokers via API

AlphaRank may interact with third-party brokers or financial institutions through secure Application Programming Interfaces (APIs) for the purpose of providing users with data or facilitating analysis. However, any such interactions are limited to the transfer of information and do not involve AlphaRank in the handling, transfer, or management of client funds or the execution of trades.

If users choose to perform trading operations via third-party brokers connected through the API, AlphaRank acts solely as a software gateway, facilitating the communication between the user and the broker within the scope of the API. AlphaRank does not engage in or control the execution of trades, nor does it have any involvement in the handling of client funds. All trading activities are executed directly by the broker as per the user’s instructions via API.

10. Termination

You understand and agree that AlphaRank may, under certain circumstances and without prior notice to you, terminate your access to and use of the Site. Cause for such termination shall include, but not be limited to, (i) breaches or violations of the Terms of Use or other agreements or guidelines, (ii) requests by law enforcement or other government or regulatory authorities or (iii) repeat violators of third party copyrights or other intellectual property.

11. Disclaimer of Warranties

THE WEBSITE, ALONG WITH ANY PRODUCTS OR SERVICES ACCESSIBLE THROUGH IT, IS OFFERED “AS IS” WITHOUT ANY REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, ALPHARANK, ALONG WITH ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, SUPPLIERS, ADVERTISERS, AGENTS, INFORMATION PROVIDERS, AND ANY OTHER THIRD PARTIES INVOLVED IN CREATING OR COMPILING THE WEBSITE, DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES, BUT IS NOT LIMITED TO, WARRANTIES OF TITLE AND NON-INFRINGEMENT, AS WELL AS IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A SPECIFIC PURPOSE.
